Mr. Walling has represented employees and employers in employment litigation for more than twenty years. His cases have involved claims of sexual harassment, and discrimination based on gender, race, age and disability. He also has litigated claims under the Family and Medical Leave Act, the state Labor Law and the federal civil rights laws.
As a School Board member of the Hamburg Central School District between 1993 and 2001, Mr. Walling experienced education issues from the perspective of an insider. Since entering private practice in 1995, he has represented teachers, parents, children and school districts in cases involving special education placements, employee and student discipline, and employment disputes.
Mr. Walling advises and represents businesses in a wide array of matters including, among others, contract and warranty claims, unfair competition and landlord-tenant issues, construction matters, and partnership disputes. Mr. Walling provides comprehensive counsel and representation to small and medium sized enterprises.
Mr. Walling’s expertise in Elder Law began when he worked in the Attorney General’s office, and defended the policies of the State Departments of Health and Social Services concerning Medicaid, Medicare and other public benefits programs. In private practice, he has advised many clients on estate planning issues. His understanding of the intricate rules of the state and federal governments allows him to give clients the “big picture” that they need to make the right decisions to protect and preserve their assets.
